Probate is the process that executors must go through to confirm their appointment under your will. Applying for a Grant of Probate involves a simple legal process that leads to a Court application. If the application is correct, the Court will issue the Grant that allows your executors to administer your estate.
Being an executor can be an onerous task. If an executor makes a mistake that results in a loss to the estate assets, the executor is personally liable to compensate the estate for that loss.
In every case we recommend that executors at least seek preliminary guidance to understand the limits of their knowledge and make sure they can see the right path to follow.
